The use of services from Newbie-Affiliate.com, [hereafter referred to as "Newbie Affiliate Site Builder Services"] constitutes agreement to these terms. You may view our Privacy Policy here.
Use of third party services.
Newbie Affiliate Site Builder Services makes use of third party services and are bound to the terms and conditions of the third party services.
On order and acceptance of order we provide the following service:
- 1 year of Hosting ($120 Value)
- 1 Registered Domain Name ($15 Value) valid for 1 year
- Installation of WordPress Website
- Installation of WordPress plugins
- Installation and customisation of a WordPress Theme
- An AutoBlogger to put instant content on your website for the purpose of Adsense and Amazon Affiliate approval. ($49 Value)
- Installation of Analytics Web tracking
- A gmail e-mail account
- An approved Adsense account
- An approved Amazon account
- We will provide a weekly backup of your website
- If you should purchase additional WordPress Plugins, themes, or squeeze pages we will install these for you at no extra cost as an added service.
- We will attend to the updates of your site as the available updates become available.
- Username & Password to access the dashboard of your website.

Please take note that we cannot be held responsible for refusal of an Amazon.com  affiliate account or refusal of a Google Adsense account due to your possible previous banning from these sites. We also cannot be held responsible if your Amazon.com affiliate account or Google Adsense accounts suspend you due to your not keeping to the terms and conditions of their affiliate programs.
Placement of Order:
Immediate payment of $150 is payable upfront with your order.
- Upon placement of an order we will check for availability of domain name and;
- We will present to you examples of website layouts, themes, and colors;
- No work will commence before we receive a written acceptance of domain name and website.
We work on a first come, first serve basis and put priority on clients that have already paid their deposit.
Newbie Affiliate Site Builder Services reserves the right to not take on a new project under certain circumstances, based on our discretion. We therefore reserve the right not to engage in business should we choose not to. In which case a full refund will be paid back to the client.
Content
All services provided by Newbie-Affiliate may only be used for lawful purposes. The laws of the United States of America apply.
The customer agrees to indemnify and hold harmless Newbie-Affiliate from any claims resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of another’s copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being infringed upon, please contact us via the contact form HERE with the information required. If the request is of a licensing issue, we may require further documentation.

- Commercial Audio Streaming (more than one or two streams)

- High-Yield Interest Programs (HYIP) or Related Sites
- Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
- Sale of any controlled substance without prior proof of appropriate permit(s)

- Lottery/Gambling Sites
- MUDs/RPGs/PBBGs
- Hacker focused sites/archives/programs
- Sites promoting illegal activities
- Forums and/or websites that distribute or link to warez/pirated/illegal content

- Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
- Mailer Pro
- Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)
Newbie Affiliate Site Builder Services, including all related equipment, networks and network devices are provided only for authorized customer use. Newbie Affiliate Site Builder Services, systems may be monitored for all lawful purposes, including to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of Newbie Affiliate Site Builder Services system(s) constitutes consent to monitoring for these purposes.
Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Access to networks or systems outside of your direct control must be with expressed written consent from the third party. Newbie Affiliate Site Builder Services may, at its discretion, request and require documentation to prove access to a third party network or system is authorized.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.
Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via our contact form and will have a response within 48 hours.

Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita):
Any site found to host child pornography or linking to child pornography will be suspended immediately without notice. Your services will be terminated with or without notice.
Violations will be reported to the appropriate law enforcement agency.
Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
Newbie Affiliate Site Builder Services reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
Newbie Affiliate Site Builder Services reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at the discretion of Newbie Affiliate Site Builder Services.
Backups and Data Loss
your use of this service is at your sole risk. Our backup service runs once a week, overwrites any of our previous backups made, and only one week of backups are kept. This service is provided to you as a courtesy. Newbie Affiliate Site Builder Services is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Newbie Affiliate Site Builder Services servers.
Cancellations
Newbie Affiliate Site Builder Services reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.
Any abuse of our staff in any medium or format will result in the suspension or termination of your services.
Money back Guarantee
We can only give a refund if no domain name or/and website has been accepted by the client. Our refund policy works on a 10 day refund system based on a NO ACCEPTANCE policy. Once a website/domain name has been accepted by a client we do not give refunds. Newbie Affiliate Site Builder Services reserves the right to not offer a money back guarantee after acceptance of website and/or domain name.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Newbie Affiliate Site Builder Services harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Newbie Affiliate Site Builder Services, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Newbie Affiliate Site Builder Services against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Newbie Affiliate Site Builder Services; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Newbie Affiliate Site Builder Services server.
Disclaimer
Newbie Affiliate Site Builder Services shall not be responsible for any damages your business may suffer. Newbie Affiliate Site Builder Services makes no warranties of any kind, expressed or implied for services we provide. Newbie Affiliate Site Builder Services disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Newbie Affiliate Site Builder Services and its employees.
Disclosure to law enforcement
Newbie Affiliate Site Builder Services may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.
Changes to the TOS
Newbie Affiliate Site Builder Services reserves the right to revise its policies at any time without notice.
